As you state, there is no way Microsoft could be seen as bound by the GPL3, however for all the shouting that has been going on in Groklaw and other places, and the coupons having no expiration date and everything, it seems that MS has made the decision to give up and not argue against it. In a way it's a victory altough not the one most people think. (I think most people seem to really believe MS is somehow distributing Linux and bound by the GPL and soon by GPL3.)

The details of the Novell-Microsoft agreement are secret. The text of the vouchers is secret. Microsoft wants to keep these secrets, so it can't effectively rebut speculation about the effect of this arrangement.
