That was to be expected. As the FSF itself says, the GPL is a simple
copyright license. Microsoft does not nothing that copyright laws require
permission for, therefore, is no party in the GPL.

And Napster is still up, because they don't actually transfer copyrighted material, so the copyright holders can't touch them.

You need permission of the copyright holder for multiplication of works
or making them public. Napster did the second.

"You need permission of the copyright holder for multiplication of works

It isn't very simple: There is 'making them public', and there is 'facilitating copyright circumvention', such as hosting a site with links, and so forth. It isn't obviously clear how the law will fall on this matter. Fact is, Microsoft are doing more than facilitating distribution; they are initiating it (giving out coupons).

The fact that Microsoft is saying that the coupons are no longer useful for GPL3 code should indicate to us that Microsoft takes this matter very seriously, which means that the FSF might be right.

Time will tell.

I'm wondering if we have actually managed to score a point against Microsoft in it's own game: FUD? As you state, there is no way Microsoft could be seen as bound by the GPL3, however for all the shouting that has been going on in Groklaw and other places, and the coupons having no expiration date and everything, it seems that MS has made the decision to give up and not argue against it. In a way it's a victory altough not the one most people think. (I think most people seem to really believe MS is somehow distributing Linux and bound by the GPL and soon by GPL3.)

And a very effective tactic it was, too. The details of the Novell-Microsoft agreement are secret. The text of the vouchers is secret. Microsoft wants to keep these secrets, so it can't effectively rebut speculation about the effect of this arrangement.
