Xandros CEO Andreas Typaldos discusses their Microsoft deal in this article
at LinuxWorld. "'We did not discuss patents [with Microsoft] and we don't think Linux violates any patents and we were not asked about it,' Typaldos said. 'It is a non-issue for us.'"

Why? Posted Jun 10, 2007 8:41 UTC (Sun) by tialaramex (subscriber, #21167) [Link] I don't agree, if you assume that Microsoft doesn't intend to start patent armageddon then it makes sense to treat any Microsoft deal as if the section talking about patents didn't exist.
Suppose a company agreed a sweet deal with you, except that it has a clause which says they will protect you against mind control by invading Martians.
This still seems like a pretty good deal, right? Yet once the deal is signed of course they can say "A lot of people believe in the Martian invasion, look at this contract" and hint that other people need to sign up for mind control protection. You can protest that you don't believe in Martians all you like, but you've signed a contract which seems to admit that they exist and some people will take an inference from that which is /illogical/ but seems intuitive.
I still think this is just about PR spin. At any moment in time, Microsoft needs some spin that will keep otherwise clueless PHBs from authorising Linux. They need new spin all the time, and at the moment it's about patent infringement.

What Xandros and Microsoft signed is a patent license deal, correct? And hasn't Microsoft said many times publicly that Linux infringes on Microsoft patents?
Is this not analogous to me agreeing to pay for someone's damaged property *after* have been accused by that someone of damaging their property and then coming out and saying "Yeah, I payed for his damaged property but it has nothing to do with my being accused of damaging it. In fact we didn't even discuss it"?

How come interoperability, specially when M$ as been mandated by court of law and regulatory bodys to provide documentation and APIs for interoperability, needs a patent deal ?
THE BIG QUESTION SHOULD BE :
How many patents does M$ violate from the *warchest* that IBM, RH and Novell put up in defense of OSS ??
It dosent need to have source code available to have a positive outlook!... and many are a show stop to M$ business, i belive...
All wars should be avoidables, but if nobody is willing to fight, then all that is left is being worst then 'slaves' at the hands of evil godfathers...
Then the appeal would be, with much reason i belive, for a rapid transition to GPLv3... and patent litigation readyness, if need be!
