I think the inherent problem there is *not* that the kernel has some swap to use, but the fact that it penalizes all processes equally, instead of the misbehaving or memory-hogging one.
I would very gladly give my kernel a gigabyte of swap if it didn't disable the whole user space whenever a single process goes astray. Penalizing just the memory hogs would make much more sense to me.
