Expecting an article about this:

but anyway. There is software which is open source in theory. Maybe with a license that sais "we can't sue you if you distribute the code". But the code is hard to find and the company discourages any development.

And it is not OK to put such projects in the same level as the Linux kernel which is a project dominated by hackers and intelligent people. Or gcc whos developers are commited to free software and their procedures are transparent.

This lie should stop at news sites. Especially ones like lwn, who can tell whether a proect is open source as in "controlled by hackers", or Pseudo-OSS-ware.
