It would appear that section 7 of the GPL could be a problem for Novell, depending on how the agreement is worded:
... if a patent license would not permit royalty-free redistribution of the Program by all those who receive copies directly or indirectly through you, then the only way you could satisfy both it and this License would be to refrain entirely from distribution of the Program.
That would seem to mean that it does not suffice for Novell to assure its customers that they are safe; the customers must be able to pass on source code to non-customers as well.
