Well, I'm neither a user of ndiswrapper nor Ubuntu, but what I think Ubuntu and other distributions depending on ndiswrapper should do, is to essentially show kernel developers a finger by shipping a modified kernel, one that does has this new "feature" disabled.
Surely, that's OK from the GPL point of view?
