If you don't want someone modifying a device... don't pass ownership on to them.
If you pass ownership on to someone else but then attempt to prevent them from modifying it, I wouldn't just call that a violation of the intent of the GPL... I'd call that fraud.

That's not in any way fraud, so long as they made a good-faith effort to make sure the device does what it was sold to do.
