What are the actual use-case scenarios for this?
Alice can pull the code in herself, in which case there's always going to be a potential licensing issue - without knowing what license the modifications are released under this is legally dodgy regardless of the history of the code, and Alice is an idiot if she doesn't ask for clarification/relicensing.
Alternatively, Carol can submit her code to Alice for inclusion, at which point /Carol/ is making the decision, and is either explicitly or implicitly granting a license to use her modifications.
Either way, it's something that sensible precautions will deal with, and certainly not a cause for the kind of FUD that's been floating around.
