It's an issue because it's stuff in debian which doesn't give users their normal freedoms. What if those undocumented initialisation sequences don't initialise the device properly? That's very hard to fix, in a way unlike most of debian, and buyers can't check it before hooking the hardware up unless the seller has a known-similar test system.
I suggested a non-free-hwsupport section which would be stuff that debian can't normally maintain, but is required to install the distribution on some hardware - sort of similar to physical hardware that we can't maintain - and would be allowed on distribution CDs.
