The GPL isn't acting on his Makefiles. He's releasing them in a bundle that says it's under the GPL.
So he's saying two incompatible things: they are under the GPL and they are not under the GPL. It isn't permitted to use the license granted by the GPL at the same time as violating it so it isn't clear what permissions are really being granted.
