Correct, this is the weak part of his defense: He is linking GPL code
with CDDL code. According to the GPL this is not allowed.
But: I fear Schilling is well aware of a GPL issue. The GPL depends on
clauses in the US copyright law that deal with "derived works". European
copyright laws do not have this, and have nothing to replace it.
Therefore it is doubted wether some of the viral aspects of the GPL are
enforcable in Europe. The FSF is aware of this and has adapted the texts
in the GPL V3 to be compatible with European laws, but the issue remains
in doubt.
So, it might be the case that Schilling is going to claim his CDDL
libraries and for example mkisofs are independend works and get away with
it.
