Read the judge's ruling. It cites a depressing number of other cases where it was ruled the government could do just about anything it pleased. I expect this was to show all these adverse cases were considered and rejected. Still, it seems sooner or later a superior court will step in and say the government doesn't have to, you know, technically, follow the law.

You could say it's a sort of judicial activism.
