ElcomSoft verdict: Not guilty (News.com)

News.com reports that ElcomSoft has been found Not Guilty in its DMCA trial. "After much wrangling among attorneys over the definition of the word 'willful,' the judge told jurors that in order to find the company guilty, they must agree that company representatives knew their actions were illegal and intended to violate the law. Merely offering a product that could violate copyrights was not enough to warrant a conviction, the jury instructions said."

Well, I guess there are 12 men and women here in the US with an ounce of common sense after all. Good for them.

Note that jurors in US courts do not decide the case. The jury answers a fairly precise question of fact put to it by the judge. In this case, the question the jury was asked and answered had nothing to do with the controversy that has surrounded this case. All the interesting questions were answered by the judge.
