Actually, I think all that happens is that company X loses the right to distribute company Y's enhancements (that is, unless they have strengthened the patent retaliation clause!).
That's partly why I suspect the FSF is unsure about patent retaliation! The clause as it stands in the GPL simply says "if you sue a Free Software contributor, you automatically lose any rights to use stuff contributed by your victim".
So X could carry on distributing their program. They just need to remove Y's mods (which, if as in this scenario seems likely, they are the prime maintainer it would be an easy thing to do).
