Hmm. Yes, I can see another possible problem with this. What if some software under the new GPL is found to have a bug which unintentionally allows access to private information. Also, what about dual-use technologies like desktop sharing applications or tty spying utilities? Would that software now be undistributable? That seems to have some of the problems of the DMCA: you shouldn't attribute intent to tools.
I don't know how to separate bugs from spyware, but if it doesn't do so already that distinction should be made.

Maybe that concept could be used. As to the draft itself - I like it! It's bold, provocative, targeted. Someone mentioned that it is a bit terse. We need terse (as in a lack of ambiguity). If the poster meant terse as in a bit dry or humour-lacking then now is the time to humanise it. May I point out as well that if there are any areas of wording in the document that are causing a lot of argument peolple should remember that a clarification of any disagreements could lead to a tightening up of the language in the final draft. We need unity on this. Roll on January 2007!
