I'm no fan of binary drivers but I find it surprising the kernel developers now consider them copyright infringement. Why not just make all the kernel symbols GPL-only or make some new OPEN-only tag? Is this new policy stated clearly in the kernel tarball? What about Linus' exception for binary drivers added before the GPL?
And finally, why sue a Linux distributor rather than the creator of the module?
