One of the problem areas is wireless network adapters where the US FCC mandates a tamperproof driver to assure Part 15 compliance. I am most familiar with Madwifi for Atheros chipsets and I know it provides a binary file for the chipset driver.

I understand perfectly well the motivation of the kernel developers, and I understand perfectly well the regulatory requirements of the FCC and why they exist. This is an interesting case where two opposing worlds collide.

There is no such thing as "tamper proof". Just do a web search and you will find software that works around, or changes, the binary only drivers to make the wifi cards transmit on other frequencies and/or with different transmission power. Ironically it is the binary only drivers that are being tampered with...
