New trial date in IBM-SCO case (News.com)

News.com covers the new trial date in the IBM vs. SCO case. "U.S. District Court Judge Dale Kimball reset the trial date to Feb. 26, 2007, in SCO's lengthy and contentious legal battle against IBM, which focuses on allegations that the computer maker infringed on SCO's intellectual property. Previously, the trial was scheduled to begin on Nov. 1."

Nothing so far has succeeded in getting IBM to buy SCO outright, so perhaps SCO hopes that inconveniencing IBM's CEO will do the trick.

I agree with the interpretation that Bruce Perens made early on in this whole mess, that SCO originally just wanted to be quietly bought by IBM.

But McBride handled it wrong--making wild accusations in public. At this point, IBM has to follow a "we prosecute shoplifters" strategy towards SCO, or IBM is rewarding SCO for its behavior and every failing software company in the world has nothing to lose by trying the same stunt SCO has.

It would be cheaper for IBM to settle the SCO case than to fight it, but prohibitively expensive for IBM to become known as a company that settles bogus lawsuits.

I fear that this is one battle that needs to be fought to secure the future of Linux. I cannot think of anyone that is better equipped to fight a lawsuit funded by Microsoft than IBM. Microsoft's goal in this matter was to prolong the inevitable until Longhorn arrived.

FWIW -- IBM may soon find itself fighting on another front with the other Microsoft funded company Sun.

This farce is starting to resemble Kafka's The Trial.

Orson Welles and Tony "Psycho" Perkins did a great film adaptation of the not-so-fictional tale of interminable legal proceedings shrouded in layer upon layer of doubt, delay, and indifference.

Darn. Why can't this judge just let the show commence? It's time to get this thing rolling. One delay after another has been only to SCO's benefit. Where's the justice?

It's starting to remind me of sitting on an airliner, parked on the tarmac, waiting for a load of lemon-scented paper napkins to arrive (see Hitchhiker's Guide to the Galaxy for the reference...)

Sorry for the reply to reply, but here's the original line--it seems it's from the radio version of HHGG: "We are also awaiting our supply of small, lemon-soaked paper napkins for your comfort and convenience. Until then, there will be a short delay."

i don't know the tit-for-tat quote, but that is also straight out of "The Restaurant at the End of the Universe"
