Licensee is responsible for contacting such third parties directly to discuss licensing details. Microsoft is sinking so fast they have to make people aware that a great deal of Open Source Software is being used in conjuction with their code, that they are not responsible for third party code and they will not defend the GPL. The reality of this is that Microsoft has been forced to make a back-handed concession that much of what is used in the workplace does not belong to Microsoft and that the standards(protocols) that are used in their products are not owned by them. The only thing I see wrong with what they've done is that they haven't properly identified the standards they claim to own vs those of third parties or sanctioning bodies.
