The issue at hand is much simpler than you make it out to be. Free OSs don't have permission to distribute the drivers period, whether or not the drivers themselves are free. For the devices to be any use -- with free or non-free drivers, free or non-free firmware -- we need the ability to actually include the firmware at all. That's what Theo's working on, and what (until recently) Linux maintainers were totally ignoring.
