it seems to me that bnetd _is_ a circumvention device
Perhaps, but only incidental to its primary purpose, and only because
there was no way that the bnetd developers could build an interoperable
server that included Blizzard's access controls. If Blizzard had
offered to provide the bnetd developers with software or a network
service that could be used in the bnetd server to provide the desired
access control, and the bnetd developers had refused to incorporate it,
Blizzard would have had a much stronger circumvention claim.
